Form for the Right of Withdrawal
In the event that the stipulation of a purchase contract takes place outside the business premises, this sale is to be considered subject to Legislative Decree No. 185 of 22/05/1999 which foresees the possibility for the purchaser to exercise the right of withdrawal. This hypothesis also includes Internet purchases made, however, by private consumers only (in accordance with Article 1469 bis of the Civil Code) therefore companies and professionals with VAT numbers can not exercise the right of withdrawal for purchases made thereas.
The consumer has the right, within a period of 14 days from receipt of goods, to exercise the RIGHT OF WITHDRAWAL. This right consists in the faculty of restitution of the purchased good to the seller and in the consequent reimbursement relative to the purchase price excluding the accessory expenses (shipping costs and any C.O.D. fee or bank commission). In order to exercise the Right of Withdrawal it is not obligatory to state the reason.
The right of withdrawal does not apply to sealed products once opened; the purchased good shall be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: accessories, manuals, parts, etc …); to limit damage to the original packaging, we recommend, whereas possible, to put it in a second box.
The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where Armeria Piovanelli S.r.l. ascertains:
- the lack of the external packaging and / or the original internal packaging;
- the absence of integral elements of the product (accessories, manuals, parts, …) or anomalies regarding the product itself;
- the absence of integral elements of the product (accessories, manuals, parts, …) or damage to the product for reasons other than transport.
In case of forfeiture of the right of withdrawal, Armeria Piovanelli S.r.l. will make the purchased good available for the sender.
In order to avail himself of the right of withdrawal, the Customer, within 14 days from the receipt of goods, must send the following form duly completed to Armeria Piovanelli S.r.l., by registered mail with return receipt. The registered letter is deemed sent within due time if delivered to the post office accepting it within 14 days from the till receipt of the goods (the postmark shall serve as prove). The acknowledgment of receipt is not an essential condition for proving the exercise of the right of withdrawal.
Before filling out the form, make sure you have the following data available:
- original purchase document, number and date of invoice or receipt and order number (provided in the order form);
- in case of partial withdrawal, item code/s of those who are intended to be withdrawn;
- indication of the payment method used for the purchase.
Equally within 14 days from receipt of the goods the customer shall deliver / make available to Armeria Piovanelli S.r.l. the products object of withdrawal, in perfect condition, in the original packaging and complete with all the accessories provided at the time of purchase, together with the purchase document. So as to limit damage to the original packaging, we recommend, whereas possible, to place it in a second box.

The return of the goods shall be carriage paid to Armeria Piovanelli S.r.l.
Without prejudice to any recovery costs for ascertained damage to the original packaging, Armeria Piovanelli Srl shall refund the Customer the full amount already paid including any shipping costs incurred during the purchase within 14 days from the return of the goods, through the same means of payment used by the Customer for the initial transaction.
